Terms of Service

Effective April 16, 2026

These Terms of Service ("Terms") are a legally binding agreement between you ("you" or "your") and Sakha ("Sakha," "we," "us," or "our") governing your access to and use of the Sakha website and study platform at sakha.app (the "Service").

By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.


1. Eligibility and Minors

You must be at least 13 years old to use the Service.

By creating an account, you represent that you are 13 or older. If you are age 13–17, you represent that your parent or legal guardian has reviewed and agreed to these Terms and the Privacy Policy, and has consented to your use of the Service.

The Service is not directed to children under 13. We do not knowingly collect personal information from children under 13 without legally required parental consent. If we learn that we collected personal information from a child under 13 without required consent, we will deactivate the account and delete the information as required by law.

California minors. If you are a California resident under 18 and posted content to the Service, you may request removal by contacting support@sakha.study. We process qualifying requests as required by California law. Removal may not be complete in all circumstances (for example, where content was reposted by others or retained for legal compliance).

2. Account Registration

To use the Service, you must register an account and:

  • Provide accurate, current, complete information.
  • Keep your login credentials confidential.
  • Maintain only one account per individual.
  • Promptly notify us at support@sakha.study of suspected unauthorized access.

You are responsible for activity on your account.

3. Service Description

Sakha provides an AI-assisted AP exam preparation platform, including microlessons, practice questions, and adaptive study sessions.

Trademark notice. AP®, Advanced Placement®, and the Advanced Placement Program® are registered trademarks of College Board. Sakha is independent and is not affiliated with, sponsored by, or endorsed by College Board.

We may modify, suspend, or discontinue features at any time. Where practicable, we provide advance notice of material changes.

4. AI-Generated Content

Powered by AI. Sakha uses artificial intelligence to generate microlessons, practice questions, explanations, hints, and other study content ("AI Content"). AI Content is produced by large language models and is not authored, reviewed, or approved by College Board or any other exam authority.

AI can make mistakes. AI Content may contain factual errors, omissions, outdated information, or inaccuracies. You should always verify important academic information against official sources, including the relevant College Board Course and Exam Description (CED) and official practice materials. Nothing on the Service is a substitute for official College Board content.

No liability for AI Content. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAKHA ASSUMES NO LIABILITY FOR THE ACCURACY, COMPLETENESS, OR FITNESS FOR ANY PURPOSE OF AI-GENERATED CONTENT, AND SHALL NOT BE LIABLE FOR ANY LOSS, HARM, OR DAMAGE ARISING FROM YOUR RELIANCE ON AI CONTENT OR ANY DECISION MADE BASED ON AI-GENERATED CONTENT.

Use of the Service does not guarantee any exam score, grade, course credit, or college admission outcome.

5. Purchases, Payment, and Access Term

Sakha offers paid plans, including an Exam Season Pass. Current options, pricing, included courses, and access period are shown at checkout and become part of your purchase terms.

Unless otherwise shown at checkout, Exam Season Pass access ends on May 31, 2026 at 11:59 p.m. Pacific Time.

No automatic renewal. Exam Season Pass is a one-time purchase and does not auto-renew unless we clearly disclose renewal terms at checkout and obtain legally required consent.

Prices are in U.S. dollars. Taxes are shown at checkout where applicable. Payments are processed by Stripe, Inc. We do not store your full card number or card security code.

6. Refund Policy

All sales are final. Sakha is a digital product and access is granted immediately upon purchase. By completing a purchase, you acknowledge that you have reviewed the available course content and agree that no refunds will be issued under any circumstances.

7. Permitted Use and Prohibited Conduct

You may use the Service only for personal, non-commercial AP exam preparation. You may not:

  • Share or transfer account access.
  • Copy, distribute, or commercially exploit Service content.
  • Use bots, scrapers, crawlers, or automation to access or extract content.
  • Circumvent security, access controls, or payment systems.
  • Violate applicable laws.
  • Impersonate others or misrepresent identity.
  • Interfere with Service integrity or infrastructure.

We may suspend or terminate accounts engaging in prohibited conduct.

8. Intellectual Property

All Service content and materials are owned by or licensed to Sakha and protected by applicable IP laws.

Your purchase grants a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for exam prep. No ownership is transferred.

User content. You retain ownership of content you submit (for example, responses and answers). You grant Sakha a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and use your submitted content solely to provide, maintain, and improve the Service for you.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAKHA DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Sakha does not warrant uninterrupted availability, security, error-free operation, or content accuracy or completeness, including AI-generated content. No exam score, grade, or admission outcome is guaranteed.

Nothing in these Terms excludes warranties or rights that cannot be disclaimed under applicable law.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAKHA AND ITS AFFILIATES, OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAKHA'S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID SAKHA IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) USD $100.

Nothing in these Terms limits liability for fraud, willful misconduct, gross negligence, or liabilities that cannot legally be limited.

11. Indemnification

You agree to defend, indemnify, and hold harmless Sakha and its affiliates, owners, officers, employees, agents, and service providers from claims, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of third-party rights.

12. Suspension, Termination, and Effect

You may stop using the Service at any time and request account deletion at support@sakha.study.

We may suspend or terminate access:

  1. Immediately for fraud, security threats, illegal conduct, or material Terms violations.
  2. For other violations, after notice and reasonable cure opportunity where practicable.

If we terminate paid access without cause, we provide a prorated refund for the unused portion of your current paid term. If termination is for cause, refunds are governed by Section 6 and applicable law.

Sections that should survive termination survive, including Sections 4, 8, 9, 10, 11, 13, and 17.

13. Governing Law and Dispute Resolution

These Terms are governed by Delaware law, excluding conflict-of-law rules, except where non-waivable consumer protection laws apply.

Before filing a claim, parties will attempt informal resolution by notice to support@sakha.study and a 30-day resolution period.

If unresolved, claims may be brought in:

  1. State or federal courts in Delaware.
  2. Courts required by applicable consumer law in your home jurisdiction.

Either party may bring qualifying claims in small claims court. Nothing here waives non-waivable consumer rights.

14. Changes to Terms

We may modify these Terms. For material changes, we will provide at least 7 days' advance notice by email or prominent in-product notice. Continued use after the effective date means acceptance.

15. General Provisions

Entire agreement. These Terms and the Privacy Policy are the entire agreement regarding the Service.

Severability. If any provision is unenforceable, the rest remains effective.

No waiver. No waiver arises from failure to enforce a provision.

Assignment. You may not assign these Terms without our consent. We may assign without restriction.

Headings. Section headings are for convenience only.

Force majeure. We are not liable for delays or failures caused by events beyond reasonable control (for example, outages, natural disasters, or governmental actions).

17. Copyright Complaints (DMCA)

If you believe content on the Service infringes your copyright, send a notice containing the information required by 17 U.S.C. § 512(c)(3) to:

We respond to valid notices under applicable law and may disable or remove allegedly infringing content. We may terminate repeat infringers in appropriate circumstances.
